Documents Needed for Property Registration in Maharashtra

Short answer: for a property sale in Maharashtra, the Sub-Registrar needs the signed and stamped deed, photo ID and PAN or Aadhaar for every party, two witnesses with ID, and the seller’s title papers. For a flat in a society you also need the society’s no-objection letter and no-dues certificate. This guide sorts the documents needed for property registration by who brings what, so nobody is turned away at the counter.

If you prefer one printable list, use our property registration documents checklist. This article explains the reason behind each paper, which is what helps you spot gaps early.

Before registration day: what the deed itself needs

  • The final deed. It must be on the correct stamp paper or e-stamp for the transaction. Our sale deed versus agreement for sale guide explains which document you are signing and why it matters.
  • Proof of stamp duty paid. Short-paid stamp duty is a common reason for delay. See our registration cost guide and cost calculator for the numbers.
  • The property description. The address, area and survey or society details in the deed must match the title papers.

What the seller brings

  • Chain of title. The earlier agreements and registered deeds showing how the seller became the owner. Missing links are the biggest source of buyer risk. A title due diligence report checks this chain before you pay.
  • Society share certificate, society NOC and no-dues certificate for a flat in a co-operative housing society.
  • Latest property tax receipt and, where relevant, recent maintenance and utility bills.
  • Occupancy certificate or other completion proof, where the building is relatively new, as lenders and buyers often ask for it.
  • Original ID and PAN or Aadhaar with the same spelling of the name as in the deed.
  • Loan documents if the flat is mortgaged, including the lender’s release or no-objection letter.

What the buyer brings

  • Original ID and PAN or Aadhaar, with matching names.
  • Proof of the stamp duty and registration fee payment or the e-stamp details.
  • Passport-size photographs. The Sub-Registrar records photos and biometrics.
  • Sanction letter if a home loan is involved, as the lender may hold the original deed.
  • Women-buyer or other concession proof, if you claim a concession. See our note on current stamp duty rates.

What the two witnesses bring

Two adult witnesses must attend with original photo ID. They do not need to know the property, but they must be present, identifiable and willing to sign. Many people forget this until the appointment, so line up witnesses early.

Extra papers in special cases

  • Power of attorney holders: the original registered or properly executed power of attorney, with ID of the holder. Read our note on the limits of a power of attorney.
  • NRI parties: passport, overseas address proof and the papers needed under FEMA. See our NRI buying guide.
  • Companies and firms: board resolution or partnership authority, and the authorised signatory’s ID.
  • Inherited property: succession certificate, will with probate or letters of administration where required, and proof of legal heirs.
  • Under-construction purchases: the builder’s allotment letter, RERA registration details and payment receipts.

Five papers people forget most often

  1. The chain of earlier agreements and deeds
  2. The society NOC and dues certificate
  3. The property tax receipt
  4. Names that match across Aadhaar, PAN and the deed
  5. Photo ID for both witnesses

The four-month rule

A deed must be presented for registration within four months of signing under the Registration Act. If you miss the window, you may face a refusal or a late-presentation process. Book your appointment before you sign, not after.

Frequently asked questions

Which documents are mandatory for property registration in Maharashtra?

The stamped deed, ID and PAN or Aadhaar of all parties, two witnesses with ID, and the seller’s title documents. A society flat also needs the society’s NOC and dues certificate.

Do I need originals or photocopies?

Bring originals for ID and title papers, plus a set of photocopies. The Sub-Registrar may ask to see originals.

Can registration happen without the seller present?

Only through a valid power of attorney. Your lawyer should check that document before the appointment.

What if the name on my Aadhaar and PAN differ?

Correct them before registration or record the difference in the deed. Mismatches cause delay.

Is a lawyer necessary?

Not legally for registration, but a lawyer checks the documents before you pay and signs off the deed, which prevents rejection and later disputes.
