Gift Deed Registration in Mumbai: Step-by-Step Guide

Short answer: in Maharashtra, a gift of a flat, house or plot is valid only if it is made by a registered gift deed. A handshake, a stamp-paper letter or a WhatsApp message is not enough. If you are giving a Mumbai property to your spouse, child, parent or sibling, this guide walks you through each step of gift deed registration in Mumbai, what you need to bring, and the mistakes that cause trouble later.

What is a gift deed?

Under Section 122 of the Transfer of Property Act, 1882, a gift is the voluntary transfer of property, made without any payment, by one person (the donor) to another (the donee), and accepted by the donee. Section 123 adds the rule that matters most in practice: a gift of immovable property must be made by a registered instrument, signed by the donor and attested by at least two witnesses.

So the gift deed is the document that actually moves ownership. Until it is signed, stamped and registered, the donor remains the legal owner, whatever the family has agreed between themselves.

Why registration is not optional

Section 17 of the Registration Act, 1908 makes registration compulsory for a gift of immovable property. An unregistered gift deed cannot be relied on to prove the donee’s title. That can surface at the worst moments: when the donee tries to sell, take a loan against the flat, get the society to transfer the share certificate, or when the donor dies and other heirs claim the same property.

If you are comparing options, read our note on why a registered deed matters in other property transfers too. The principle is the same: ownership follows the registered document.

Who can give and receive a gift?

  • The donor must be an adult of sound mind and the full owner of the property, free to give it away.
  • The donee can be any person, including a minor (a guardian accepts on the minor’s behalf).
  • The property must be existing property. You cannot gift something you may own in future.
  • Acceptance must happen during the donor’s lifetime. If the donor dies before the donee accepts, the gift fails.

Joint owners can gift only their own share unless every co-owner joins. If the flat is in a co-operative housing society, check the society’s bye-laws and transfer requirements before you sign (see our note on deed drafting).

Gift deed registration in Mumbai: step by step

  1. Check the title. Confirm the donor’s ownership, the society share certificate, and that there is no loan, mortgage or litigation on the flat. A gift cannot give the donee a better title than the donor has.
  2. Get the deed drafted. A good gift deed names both parties and the property precisely, states that the gift is out of love and affection with no consideration, records acceptance by the donee, and says that possession has been handed over. It should also say clearly whether the donor keeps any right (for example, a right to stay).
  3. Pay the stamp duty. Stamp duty on a gift is payable on the deed before registration. For gifts to close relatives, Maharashtra charges a much lower amount than for gifts to others. The exact amount depends on the relationship and the current notification, so confirm it before you finalise the document. Our cost calculator and stamp duty guide are good starting points for the general rates.
  4. Book an appointment at the Sub-Registrar office that covers the property, through the state’s online registration system.
  5. Sign before the Sub-Registrar. The donor, the donee and two witnesses attend in person with their original ID. The Sub-Registrar records photographs and biometrics and registers the deed.
  6. Collect the registered deed and keep several certified copies. Then update the society records and the property tax and utility accounts in the donee’s name.

Documents you will need

  • Original title documents of the property (earlier agreements, deeds, share certificate)
  • Recent property tax receipt and society no-objection or no-dues letter, where the society requires it
  • Aadhaar and PAN of the donor and donee, with names spelled the same everywhere
  • Passport-size photographs of both parties and two witnesses, with their ID
  • The signed draft gift deed on the correct stamp paper or e-stamp
  • Proof of relationship where a family concession is claimed

Timing: do not let the deed go stale

A document must be presented for registration within four months of its execution under the Registration Act. If you sign the deed and then wait, you may face a refusal or a late-presentation process. Plan the signing date and the appointment together.

Can a gift deed be cancelled?

Rarely. Once a gift is complete, the donor cannot simply take it back. Under Section 126 of the Transfer of Property Act, a gift can be revoked only if the deed itself provides for revocation on a stated condition that does not depend on the donor’s will, or in the same situations in which a contract can be rescinded (for example, fraud or a mistake). If you want to keep control, a will may suit you better. We also cover this in a short video on our YouTube channel.

Common mistakes to avoid

  • Signing a gift on plain stamp paper and never registering it
  • Gifting a share that belongs to a co-owner who has not agreed
  • Skipping the society, so the share certificate stays in the donor’s name
  • Using a deed that does not mention acceptance or possession
  • Assuming a gift deed is a tax-free way around every other rule. Tax, including on later sale, depends on your own facts, so take advice

Gift deed or will: which should you use?

A gift deed passes ownership now and is hard to undo. A will takes effect only after death and can be changed any time during your life. If you want the recipient to own the flat immediately, use a gift deed. If you want to keep control for life, consider a will. The right answer depends on your family, your tax position and how much control you want to keep.

Frequently asked questions

Is a gift deed valid without registration in Maharashtra?

For immovable property, no. Section 123 of the Transfer of Property Act requires a registered instrument.

Does the donee have to be present at registration?

Yes. The donor, the donee and two witnesses normally attend in person. Where a party is abroad, a properly executed power of attorney may be used, subject to the rules for that document.

Is stamp duty on a gift to a family member lower?

Yes, Maharashtra gives a concession for gifts to specified close relatives. Check the current rate and the list of eligible relatives before drafting, because notifications change.

Can a mother gift her flat to her daughter?

Yes, if she is the full owner and the society formalities are met. A registered gift deed is needed.

Can the donor take the property back later?

Only in the limited cases Section 126 allows. Put any conditions in the deed itself.

How long does gift deed registration take?

The registration itself takes one visit to the Sub-Registrar office. Drafting, checking title and paying stamp duty usually take a few days before that.
